I guarantee you, that if Colorado had no mace or any other weapons, this would not have escalated. Benn was being a dick, but, at no point should this have escalated. Colorado – did escalate this. Ok for those of you making this a black/white thing slap yourself VERY VERY HARD! Second, it’s a NEGLIGENT homicide/manslaughter…PERIOD…END OF STORY! The white guy was WRONG pepper spraying, the black guy had every RIGHT to defend himself UNTIL he turned and chased the white guy! At that point he failed any CCW training and laws! If he would have drew his firearm as he was being sprayed and back-peddling he would have been justified shooting. The second he pulled his weapon and the white guy fled from him he should have deescalated the situation by withdrawing and seeking help instead of pursuing! Now if he did pull or flash his firearm BEFORE the guy peppersprayed then MURDER in the second/third degree!
