The Sherman Act, a federal antitrust law, prohibits the coordinated activity between two or more parties to monopolize the market and harm competition. This offense, which is prohibited under Section 2 of the Act, requires proof of a combination or conspiracy and an overt act furthering the conspiracy. The act makes it unlawful for any person to monopolize, attempt to monopolize, or combine or conspire with any other person or persons, to monopolize any part of trade or commerce among several States or with foreign nations.
The three core federal antitrust laws are the Sherman Act, the FTC Act, and the Clayton Act. The Sherman Act outlaws unreasonable restraints of trade and monopoly power, which is the specific intent of acquiring monopoly power. To establish a section 2 violation, the government must prove that the percentage of market control equivalent to monopoly power differs with the type of market involved.
Conspiracy to monopolize refers to two or more independent actors that conspire to establish a monopoly seller (or buyer) in a properly defined relevant market. A specific intent to monopolize means an intent to acquire or maintain monopoly power in a market via anticompetitive or exclusionary conduct. A claim for conspiracy to monopolize requires a plaintiff to prove the existence of a combination or conspiracy to monopolize and overt acts done in the market.
In summary, the Sherman Act prohibits monopolization, attempted monopolization, and combination or conspiracy to monopolize by firms. It requires the government to prove that the coordinated activity between two or more parties to monopolize the market and harm competition is a violation of the antitrust laws.

Is a monopoly a cartel?
A cartel is defined as a cooperative consisting of a few competitors who work together to maintain high product prices.
What is an example of monopolizing?
Monopoly refers to the control or control of a group or entity, often used in various contexts such as the entertainment industry, the smartphone market, or the digital advertising supply chain. Examples of monopolization include a company monopolizing the conversation, a company monopolizing the computer operating systems market, or a group taking almost all of the camping area. The Justice Department has also sued companies like Ticketmaster and Live Nation for allegedly monopolizing the live entertainment industry.
Google has been accused of monopolizing three major links of the digital advertising supply chain, which funnels over $12 billion in annual revenue to websites and apps in the US alone. RealPage has also been argued to have monopolized the market for this software. These examples are compiled from various online sources to illustrate current usage of the word’monopolize’.
Is it legal to monopolize?
The Sherman Antitrust Act prohibits unreasonably restrained trade, including agreements to fix prices or wages, rig bids, or allocate customers, workers, or markets. It also makes it illegal to monopolize, conspire to monopolize, or attempt to monopolize a market for products or services. An unlawful monopoly exists when one firm has market power for a product or service, obtained or maintained through anticompetitive conduct. Monopolization offenses may be prosecuted criminally or civilly.
The Clayton Act promotes fair competition and prevents unfair business practices that could harm consumers. It prohibits actions that might restrict competition, such as tying agreements, predatory pricing, and mergers that could lessen competition. An illegal merger occurs when two companies join together in a way that may substantially lessen competition or create a monopoly in a relevant market.
This reduction in competition can harm consumers by potentially leading to higher prices or fewer choices for products or services, and workers by potentially leading to lower wages or fewer employment options.
What is the crime of monopoly?
Monopolization is an illegal form of monopoly behavior in the United States, with categories such as exclusive dealing, price discrimination, refusing to supply essential facilities, product tying, and predatory pricing. It is a federal crime under Section 2 of the Sherman Antitrust Act of 1890, similar to the “abuse” of a dominant position in EU competition law under TFEU article 102. In Australia, it is illegal under the Competition and Consumer Act 2010 (CCA).
The offense of monopolization has two elements: the defendant possesses monopoly power in a properly defined market and has obtained or maintained that power through conduct deemed unlawfully exclusionary. The defendant must exclude rivals on some basis other than efficiency.
For decades, courts have drew the line between efficient and inefficient exclusion by asking whether the conduct under scrutiny was “competition on the merits”. Courts equated such competition with unilateral conduct such as product improvement, economies of scale, and innovation, which were lawful as they constituted the normal operation of economic forces. However, courts condemned “unlawful exclusion” such as tying contracts, exclusive dealing, and other agreements that disadvantaged rivals. This distinction reflects the economic theory of the time, which saw no beneficial purposes for non-standard contracts.
Is monopolizing unethical?
Monopolists exploit consumer advantages by setting prices above the competitive equilibrium level, which causes consumers to continue purchasing the product or service at higher prices. This unethical practice serves to perpetuate market distortion.
What does it mean to monopolize people?
The verb “monopolize” refers to the act of dominating a person or conversation, often leading to excessive talk or preventing others from participating. This can be seen in the state’s dominance in various sectors such as telecommunications, banking, energy, broadcasting, forestry, tourism, and transport. The profits from monopolizing innovation serve as a platform for political-economic leadership. The war expenses monopolized a significant portion of the budget.
What does try to monopolize mean?
It is not uncommon for businesses to attempt to monopolize a market by controlling the supply and price of a specific product or service.
Is monopolizing good or bad?
Monopolies are detrimental as they control the market, leaving consumers with no choice but to buy from the monopoly. They lack control over price and quality, and there is little incentive to innovate. Amazon’s share of U. S. online retail sales was estimated at 40 in 2023, but there are numerous competitors in retail sales for consumers to choose from. Overall, monopolies hinder innovation and consumer choice.
What does it mean to monopolize an item?
The term “monopoly” is defined as the exclusive control or use of a market or commodity, preventing other entities from accessing or utilizing it.
What does it mean if someone is monopolizing?
Monopolizing in English refers to controlling something completely and preventing others from affecting it. The company had monopolized the photography market for decades, ensuring they didn’t worry about competition. The SMART Vocabulary includes related words and phrases in various languages, including English-Chinese (Simplified), Chinese (Traditional), Dutch Dutch, French French, German German, Indonesian Indonesian, Italian Italian, Japanese Japanese, Norwegian Norwegian, Polish Polish, Portuguese Portuguese, Spanish Spanish, Swedish Swedish, Arabic English, Bangali English, Catalan English, Czech English, Danish English, Gujarati English, Hindi, Korean, Marathi, Russian, Tamil, Telugu, Thai, Turkish, Ukrainian, Urdu, and Vietnamese.
What is an example of a monopoly?
In many instances, public utilities such as gas, electric, water, cable TV, and local telephone service companies operate as pure monopolies. Notable examples include First Data Resources, Wham-O, and the DeBeers diamond syndicate. A pure monopoly is defined as a market structure in which a single firm controls a unique product type and exercises price control through the use of price makers. It is characterized by blocked entry and non-pricing competition through public relations.

What sets Kendall apart from other true crime Youtubers is her usage of actual archive footage for each case and the ease of which she tells the ‘stories’. Even if it is a well known case it becomes new again because of her engagement with the material! And gotta love her mushroom sweatshirt! I want it! 👍😍
McHomies, I said this no longer happens in the USA. Multiple sources online say that. If it’s still happening in some places around the United States, then they must be reporting wrong! I’ve never played this game or seen it in person so I have no idea if they do it in America still or not. Most sources say they stopped in 2016. As far as other countries, it’s very active. Especially in the UK, y’all be lovin it there.
I’ll never forget, a few years ago while I was walking into a shopping mall, there was a lady jumping around enthusiastically and cheering while holding a McDonald’s cup. She said she had won the car, so everyone knew the car prize for that monopoly was the Camry (Toyota). Naturally, everyone walking passed were surrounding and congratulating her on winning the Camry. So at one point the lady had to sit down on the floor because she was so overwhelmed. One girl that was just walking by stops and says “that’s amazing! Can I see it?” the woman turns the cup toward the girl to show her the label, and the girl goes, “oh it doesn’t say Camry it say CAMERA….”. And the instant look on the woman’s face was utter embarrassment. I felt soooo bad. But ever since, it has taught me to TRIPLE check my winnings before making a scene 😩😂😂.
So, I live in Jacksonville, and Marvin Braun (Jerome’s step brother who was interviewed in the Hulu series) was a regular of mine when I worked at Aerie. He was my absolute favorite customer, he would pick up young dancers from local strip clubs and bring them in for a free shopping spree and would constantly offer to buy me and my employees expensive dinners when he was in town from Miami. One day during a heart to heart during my shift he was talking to me about the importance of integrity and brought up that he was involved in a McDonald’s conspiracy and that his integrity is what kept him out of prison. I 100% thought he was spewing bullshit until I watched the Hulu series. I was so floored when he popped up on the screen, and laughed out loud. 😂
OMG! I know someone that was in on this! It was my friends mom. Her sister and husband were high up in the scam and recruited her to cash in a $500,000 piece. She got arrested. It was BIG news in our little town. There is also a series on it. It’s called McMillions on HBO but no movie yet. She was one of the 8 that got arrested! Her sister and brother in law were arrested too!
We still have Monopoly here in Canada but let me explain to you why it’s almost impossible to win. 1. Workers of McDonalds or people related directly to them are not legally allowed to play. 2. There are no huge instant prizes here. If you want to win the car, you need to collect all three properties and then you have the CHANCE to win because you’re added to a draw. 3. Game pieces are spread throughout the country. You have to travel across the country in order to complete a set. It is impossible to complete a set without travelling because… 4. …Buying game pieces online is illegal. If you win, they will investigate you and if you didn’t travel or there is any evidence against you that your fame pieces weren’t won legitimately, you will not receive any prize. This is why you should keep your receipts.
I remember this whole thing so well. For some reason, during that time I really got into collecting those game pieces. A group of friends from work and I started pooling our pieces and we actually got two of several properties. We weren’t surprised when we didn’t win, but when I heard about this scandal I was furious. It didn’t make logical sense for me to be so angry because it’s pretty much a given that we wouldn’t have won anyway. But it felt like a kick to the collective chops of the common man and I have to admit that to this day, I still feel a little betrayed.
If I got this right, Jerry’s wife told him that he should spread the winning pieces out to different people in different states who aren’t related to him or his family in any way, and then comes up with the amazing idea to give it to her own friend??? As if they wouldn’t be able to trace that as well?
In the U.K. it’s still a huge thing! I know I look forward to it every year, it’s just fun to look for the prizes. I personally only really play for the food but I’m sure last year they stopped putting Big Macs in the prices or any burger or something like that, so that was kinda a disappointment. But you can still win McFlurrys, fries, drinks, fruit bags (😴), and supposedly you can win big money and cars etc but honestly I’ve never ever heard of anyone winning the big prizes other than a speaker 🤔
We still have it going here in Australia! Last time I played it when it was going was September 2020, I won a few things such as a free trip to the aquarium x3, a free trip to the top of the 360 centrepoint tower in Sydney, heaps of food and I also won gift cards for stores.. that involves me buying McDonald’s about 2-3x a day I’d spend at least 300-400 a week on McDonald’s just to try and win the big prizes.
Hey Kendall, just to let you know, it IS still running in the UK however there’s no cash prizes. It’s only free fries, hash browns and things like that. I just thought I would give this information out to everyone as it’s something that happens quite regularly in the UK McDonald stores. But anyway my Quarantine is just boring but I live for these type of articles. Thanks Kendall. I hope you are well x
Can talk about the Sylvia Likens story ? It’s so sad and heartbreaking ☹️. It’s about a her and her younger sister staying with a family because her parents work out of town and she gets abused by the family she stays with, including the kids in the family and other people. She’s get tortured and malnourished. It’s just so sad. 3

Honestly, all I wanted was free food when it came to McDonald’s Monopoly and they were fun to peel off. I was really excited as a kid when they gave those free Coca Cola glasses away. We went there too many times when I was a kid and ended up with at least 5 of those glasses conveniently enough all three of us got our favorite colors and we still have one of the clear ones.
