Just FYI. Jorge did NOT have any criminal history until he met Sarah and she claimed he assaulted her and then dropped the charges every time. Every police report included injuries on Jorge too but he refused to call the police on Sarah or tell on her. But he had no history of any arrest before Sarah or domestic violence. All he had was traffic infractions.
Alcoholics live in a state of denial. She lost her previous marriage over her drinking. Her ego is downplaying the problems it creates in her life. While Alcoholism and Substance Use are mental health diagnosis’ – consequences are often what makes them acknowledge it’s real. I personally don’t think Substance Use should ever be regarded as a defense even if the laws change for other diagnosis’ Many people have gotten sober and clean as a result of their consequences. Sarah is in denial in my opinion- Her full blown ego is her most dangerous trait. I can only imagine what the attorneys that withdrew had to put up with given her manipulation & lying to herself.
I understand why Whitney is so confused about why SB was denying drinking. It’s not logical, but here’s my take – I’m a sober alcoholic and when I was still drinking, I was desperately trying to keep it together. I didn’t want any of the bad things in my life attributed to drinking because that meant that drinking was a problem. I can see how if she’s in denial about her alcoholism, this would be her answer. I’m certainly not saying alcoholism is why any of this happened. Purely just saying this could be why she denied being drunk.

If you watch all the bodycams (from other arrests) IMO it is clear she used the police to control and threaten Jorge. She said to two witnesses “put the fear of god/ the police in him”. Even the cops don’t believe her and are sick of it in the articles. It says a lot to me that they empathize with Jorge in these situations. The one where she comes out jumping in excitement and talking like a toddler is sickening. She had called the cops on him so many times. Now claiming she was so afraid and battered but doesn’t call this time? Not believable. She went upstairs and went to bed thinking he could get out (her words). No person afraid of their abuser would go up to bed comfortably thinking he could and would get out. They would be terrified of what would happen to them when he got out. We all know Sarah lies by now. Reasons I believe she made up or over exaggerated the whole “they tricked me into an interview telling me I was coming to get the phone”. At some point in the interview she pulls out her list of questions. She asks when she will get her phone back. They tell her they are still looking through everything and she’s telling them to look at this or that on the phone. She does not say “you told me I could get it today, I thought that’s why I’m here”. She also brings up how she doesn’t want them to come when her kid is there and they tell her something like “yeah we told you we don’t want to do that, that’s why we had you come here today to ask questions”. She is full of it and making up stuff to try to find loopholes.
I think Sarah is used to getting away with bad behavior. Plays the victim. From grammar school all the way up to adulthood. We’ve heard a lot from Boone over the years of this case and through the evidence and her letters – but I don’t think I’ve ever heard/read/seen Boone mention her son once. Never mentions him or missing him, even when she argues about bond or whines about delays in her case. So bizarre. She is so selfish.
If I were a juror on this case, given the evidence we currently have, it would be difficult for me to find her not guilty of involuntary manslaughter. Even if her interrogation is thrown out there is so much evidence against her from initially lying to the police officers, to the article she recorded on her phone and the comments she made on it (VERY damning imo), the interview with the neighbor about what they heard along with the bat near the suitcase and the autopsy report.

I don’t think the fact that he is coherent in the suitcase necessarily means he voluntarily got in. He absolutely could have BUT, it’s also possible she got him in the head with that bat and shoved him in while he was still unconscious. It was literally driving me nuts for four years to the extent that I literally laid down and let my 13 year old child try to shove me in a similar sized suitcase without help (mind you, I’ve got 32ish lbs on him- 134 vs 102). It took her just under 2 min (1 min 41 sec) and she wasn’t even out of breath! On a side note, I promised her McDonald’s AFTER she unzipped me and made damn sure she wasn’t mad at me for anything first- don’t try this at home, especially if your teen is pissy! 😃
Wouldn’t it have been better for the defense to go for an accident? I mean, really, I don’t think she meant for him to die. It seems to me, if I were on the jury, it would be harder to convince myself, that, it was anything more then a tragic accident. I’m curious if Whitney is familiar with that case about Utah behavioral programs, it’s on Netflix, Paris Hilton appears on it & talks about them in her book. I’d love to hear her speak on that one. I was sent to one from 14-16 years old and 30 years later I’m still traumatized… so much brainwashing tactics, I mean legitimate, intentional, calculated straight out of a book, textbook definition, abusive, grooming, isolation to the extreme, military/ intelligence/ cult level brainwashing… break you down to build you back up, without the build you back up part… and lots of trauma, PTSD etc. Except you know your parents PAID GOOD $ to send you there (to be fair the parents were brainwashed too). Kids ending it just to get out or running away never to be seen again, lifelong trauma… I tried and tried and failed to get them shut down after I was out. I begged CPS to help the kids still there but they packed them all up and moved them out of state. He’d kept getting shut down and he’d just open up a new one with a different name. I can’t for the life of me understand Utahs CPS laws or understand how these places aren’t regulated or enforced by federal as they have kids from different states, the one I was sent to operated in Nevada and Utah. Shouldn’t federal government be able to step in? I think it’s a discussion as a society we need to keep having because most people don’t know this abuse is happening to kids LEGALLY (or at least without repercussions).🤞🏼
If a lawyer cannot allow their client to lie, how does getting the interrogation thrown out change anything she can claim? If they claim battered spouse and claim it was intentional, that would be a knowing lie because she said it was an accident. One of the neighbors was interviewed and he said he could hear them screaming at each other that night and then it suddenly went silent, then 10-15 minutes later he heard crashing noises going down the stairs. I think she knocked him out and believed he was d**d, so she stuffed him in the suitcase and rolled him down the stairs and at some point he came to inside the suitcase

Two – Here’s my two cents (cause I know y’all were waiting with bated breath) on her question about mental health awareness and the potential as awareness, empathy, and conversations continue to grow around mental health issues for that to be employed more in the legal realm: As a person with depression and anxiety I would strongly dislike it if people started using that (or other likewise manageable and treatable mental health issues) as a defense. There are millions of people who struggle with mental health issues who don’t go around murdering people. So while I empathize with the struggles of all, I don’t feel like it comes close to being a criminal defense and would really do a disservice to many people.

Easiest case I can remember, there’s not a lot of intrigue here, she’s disgusting in every way imaginable. You’re absolutely right that she thought she would tell the cops that she’s a responsible mom that doesn’t like to drink and was trying to change Jorge even though he hits her, and she absolutely believed that the cops would talk to her and believe her and that she wouldn’t be on the hook for this. She clearly had no recollection of taking those articles, so she thought her manipulation tactics were working perfectly.
Drinking is obviously a major issue in instigating the violence between these two. He got into the suitcase, himself, of his own volition. She zips him up, all in fun. But then? Drunk on alcohol and on a power trip, she taunts him and won’t let him out. Then she goes upstairs, passes out and he dies. Pretty clear. Probably she was telling the truth when she kept using the word. “unintentional”.
There is something I’ve noticed about this article that hasn’t been brought up much. We all know it’s upside down in the first article. In order to zip it, it needed to be right side up. How did it get upside down? In the second article it’s right side up because she flipped it. I think like the neighbor said… They heard the thumping down the stairs. I think it was the suitcase. If so, she had to have drug the suitcase from the staircase to where it sat in the article. She “played” suitcase before. There were pictures on her FB in 2016 with her son being zipped up in that sane suitcase. In those, the suitcase was right side up. It was investigated by DCF at that time. That is according to WFTV February 27, 2020 online. In that article, it shows the pictures with a blurred face of her son in that suitcase. So this isn’t her first time doing it.
Sarah was toying with Jorge, taunting him in her article… In her interview outside the apartment she says “zipped him up, MAKE HIM SQUIRM A LITTLE, whatever…” 😮 She might now be purporting she was in fear for her life but she could easily have left the apartment while Jorge was still secured in the suitcase and called for help to save his life and her own.
I really enjoy Whitney’s input! My guess is that the judge will grant a small continuance last minute. He may even have already reserved some time on his calendar. I think that he will do his best to push this case to trial before the Christmas mayhem hits, maybe even before Thanksgiving, but he’s gonna try to make them all scramble regardless and he’s right to; it’s been way too long.

Questions: 1) Boone has stated that there is multiple photos on her phone portraying bruises and injuries. We also know that Cellebright did their download and that that information was given to her. Within the boxes of information. “IF” they were really on her phone why does she not already have those photos? Are they suggesting they are purposely missing? 2) They are trying to get all the interrogation thrown out on a technicality of the Miranda Rights. Yet another attorney of hers has publicly stated that they were read to her correctly visually off camera but can be heard. Yet this interview was not meant to be an interrogation, ended up being an interrogation even though she read the Miranda Rights and left out that last line. Although it wasn’t worded properly she still said you still want to do this. You Peter as an attorney in Florida. And I’d like to say that I have watched him way too many true crime trials documentaries interrogations. Almost always they are right exactly the same way this investigator read them. My question is if this is thrown out on that technicality can other cases go into a appeals process on the fact she got these thrown out but they didn’t? Could this have a domino effect? 3)Also, how will she get the body cam footage be suppress when she voluntarily just rambled without being asked questions. Wouldn’t this be a conflict or conflicting statement of her now? 4) If they bring up Jorge’s previous arrest record wouldn’t that open up her’s? And can they still use them even if they didn’t make it to trial or was thrown out, not prosecuted.
But isn’t the point of hide & seek that you DON’T know where the person / people are? There’s articles of her KNOWING where he is (and laughing at his distress) and TELLS the cops that SHE helped him get in the suitcase & zipped it up. That is not hide & seek. So what’s that game? Given Sarah’s personality & demeanour so far, I can possibly see a situation where they were playing hide & seek and he successfully hid himself in the suitcase (whether unzipped or partially zipped) and she didn’t like the fact that she lost the game – so lost her temper & decided to teach him a lesson (and MAYBE fell asleep) but that doesn’t take the suitcase down the stairs into account (unless she realised in the morning & hoped she’d be able to dispose of the suitcase & body but didn’t have the strength but we won’t know whether the injuries happened before or after death). He wasn’t making threats that we could hear about retaliation; he was begging for her help. There is NO way that Sarah would allow a mental illness defense. She thinks too highly of herself.
I think it would be accidental if she was so inebriated, she was about to physically pass out within minutes, she didn’t have the time to cognitively and physically unzip the suitcase to free him. When you know or feel like about to pass out, you instinctively look for a bed to fall onto. That is what Susan did when she went up the stairs, because she knew there was a bed in the room. Most likely, as soon as she was close to the bed, she flopped on it and fell asleep. The reason she vented so angrily at him, hesitated unzip him, because he threatened to attack her, or because she expected he would due to being abused by him before.- self defense and battered spouse syndrome. Maybe she intended to call the cops, but because she was passing out within minutes, she couldn’t in time to save his life. Whatever she said in the Interrogation is irrelevant.- shouldn’t factor into deciding 2nd degree murder. All of her problems that came after were due to her own ego, proves she is guilty of being her own worst enemy.

Also, I don’t believe in this “Battered Spouse” defense, Sarah Boone looks like and acts that she gave as much abuse as she received. Not every woman is a “Damsel In Distress” and Sarah is definitely not one of them. I know nothing of Jorge but it seems that Sarah can start an abusive fight with no problem. During the interrogation it seemed to me that she was playing dumb when they brought up the article. I feel like she wants her phone so bad bc she deleted the articles and wants to confirm that she did in fact delete them and then cry how her rights were violated bc detectives didn’t get her permission to get her phone records. Sounds like tampering but I’m sure she could get her attorney to spin it.

29:29 – This is one of the areas where I take severe umbrage to how the law works, My mother was a lawyer (contractual, not a trial lawyer) but I grew up hearing about all language used by lawyers. It’s so confusing and almost reminds me of old english in how it uses grammar almost. I get that all your bases have to be covered and that means referring to a LOT of stuff which means having to use a LOT of words but honestly, there’s got to be a better way. I wonder if the law is that confusing so normal people CAN’T defend themselves. Government doesn’t WANT it’s citizens to truly REALLY TRUELY understand their rights. I totally agree and thought that the defense should have went that route and fought for that with the judge instead of just abandoning the “accident” all together. I truly believe he got in voluntarily but not because of fun and games.. I think she ordered him to get into the suitcase as punishment for him cheating on her. As ridiculous as this sounds; remember that he had no place to live but at the townhouse and Sarah could have had him thrown out at any time or had the police pick him up for violating the restraining order. To appease her he got in not knowing she was going to keep him in the suitcase. He just never knew she was going to keep him in the suitcase as long as she did.
This is just my opinion. I read somewhere that Sarah and her bf met in a recovery 12-step group. That that they were drinking, probably too much. Most alcoholics, if asked how much they drank will say “just a little”, she told cops they shared “a bottle of wine”. They could have had a lot more to the extent she had a black out and really does not remember much. She slept a long time (common), then found her bf already dead. My problem with her is that from the very beginning, starting with the cops coming out once called, is that Sarah has NEVER shown any sympathy or compassion or remorse for a dead boyfriend. Had I drunk so much I passed out and slept for hours, then found my fiancé dead, at some point after the shock would have shown some sadness. I know we all react to grief differently, but in the last 4-5 years not once has she looked even a bit sad for a dead person she used to care about.
After following as much of this case as possible, I have come to the conclusion that she is an evil genius. Starting with the cop’s body cam. Continuing into the Sheriff’s Office interviews. She hasn’t stopped her ridiculous shenanigans since the the very first interview. It’s something ALL THE TIME. She’s managed to keep her case out of court all this time. And she’s yet to be tried.

I do have a question though and it may end up being really long I apologize but I don’t know a shorter way to ask! So, being a defense attorney and having a client like Sarah Boone, how do you do the mental gymnastics to actually put on a battered spouse defense and actually believe it is a possibility? I am like your wife seeing this from a lay person’s perspective and although we are presumed innocent until proven guilty, I don’t know how you go from viewing objective evidence like the articles she shot herself and the bodycam footage to an assertion of “well what happened AFTER she shut off the camera? What terrible thing did he say that made her afraid for her life?”. How do you go from one extreme (it was an accident, we were playing and I fell asleep) to I was taunting him and he sounded scared for his life and AFTER i turned off the camera he flips out and starts threatening me? How do you allow yourself to believe that this hypothetical conversation MIGHT have happened without suborning perjury? I’m sorry if that is confusing but I am confused so I don’t know to ask more clearly how a defense attorney in this case is able to mount this defense and not feel like he is breaking the law? It doesn’t make any sense to me. I also see the world and the law in black and white but I know attorney’s need to be able to see the gray areas to effectively defend their clients.
Well, they were NOT playing hide and seek, because she zipped him in and knew exactly where he was. I personally believe he got in willingly. The neighbor says a loud argument began sometime in the evening around 10 maybe for about 15 min. (upstairs), followed by 15 min. of silence, followed by the sound of something or someone falling down the stairs with such force it shook the wall between the apartments. I think she took the bat they had upstairs and hit him, put him in the suitcase and then when he came to, pushed him down the stairs.

While a personality disorder (or several in her case) can explain why she did what she did, it absolutely does NOT excuse it. A mental disorder can explain why someone did what they did, but it does not excuse their actions or give them a “get out of jail free” card (in most cases). Courtney Clenney is going that route too.
Her money from the state is not exactly limited. She’s spent over $205k with her past lawyers being paid and their expert and prison break work but before this lawyer jumped on board and the new prison break extra, experts extras and their travel expenses. That didn’t include and if the court or its staff time or the jail and its staffs time. I think it’s going to come in at just under 1/2 a million. That is the least limited amount I’ve ever been aware of. Now we’re also going to include a cosmetic and hair provisional and a seamstress for her tailored garments. Also remembering this new lawyers and their time and travel expenses plus the assistants. Like it’s never friggin ending with this narcissist w/ BPD creating and getting flying monkeys all around her. It’s all gross imo.
I’ve yet to see this question asked or addressed: what was the size and stature of this man?? I’m 5’3, petite-ish and I don’t think I could fit into my largest suitcase. I simply don’t think I can fold up that tightly. I don’t understand how a human adult male could fit in a suitcases, unless he’s smaller than me.
I think Sarah has a personality problem that includes big anger She is also an alcoholic. When she drinks, like all people. she loses her inhibitions. Uninhibited her extreme anger comes out and is magnified. While not a defense, her judgement was impaired due to alcohol. Basically she got drunk and accidently killed him. It’s second degree because of the malice displayed on those articles.
I think it’s hard for some people to realize that there are just some people out there Who really Just act this way. and yeah, thinking : Well, look how she’s acting.She must have something wrong with her. But in reality, she doesn’t, this is just who she is and her personality, and I think it’s hard for people who haven’t really dealt with people like sarah, too understand that’s just their normal self.
i’m still of belief that she remembered taking that article…she managed to explain everything in the article like leaving enough space for Jorge to get his fingers through and turning it on it’s side…And her reaction to seeing the article in the police interview says it all…Her first reaction was the battery was running low… there was no shock or surprise there.
The waiver is not the problem. The problem is they did NOT tell her that she could quit talking at anytime and ask for a lawyer . There’s a good chance, once she agreed to talk to the investigators she may have felt committed to follow through not knowing she could stop and wait for a lawyer. Sarah Boone is not stupid. I’m sure there was a point during the interview she began to think they were treating her as a suspect rather than a witness and probably wanted to stop talking. The interrogation and any interaction with the police post Miranda should definitely be thrown out. Don’t forget, in her mind, she went to the police station as a witness, not a suspect.
When they were interrogating her she tried figuring out what they approved or disapproved of & would switch up her story based on their questioning. They asked if she was drunk, she denied it. They asked if she did this sober, she blamed the wine after all. They asked about her claims of Jorge’s abuse so she painted him as a violent drunk. When they asked if she was punishing him for that, she went on about how he changed & even pointed out she got arrested for DV once as well. It’s just a whirlwind of gaslighting with her. That’s what her lawyer is doing for her(gaslighting)& she will do the same to the jury. I think she really believes that’s all she has to do. Most definitely she thinks her lawyer is doing an awesome job, does what she wants, & that she has an extremely high chance she’ll walk out that jail soon.
Wow, I haven’t seen that article. So hard to watch. Her laughing and mocking him while obviously being impaired by some substance is bone chilling. She is just an evil person. And it always seemed odd to be that she’s been so adamant about getting her phone. She’s asked for it so many times and I think she just wants to see the article again, like when serial killers enjoy reliving their crimes.
The problem with Sarah Boone, is she does not comprehending someone has died and she could have prevented it. All her lawyers understand that. But Sarah refuses to realize the truth and take responsibility. It as if someone was drowning and if you have every means to save that person but choose not too because they hurt your feelings. And you were also the one to help them into the pool, knowing they couldn’t swim.
I don’t believe a word that Sarah is saying, l think that she was the abuser. They were drinking, Jorge passed out, she put him in the suitcase, pushed him down the stairs, he then came to, and then she started saying for all the things you did to me. She is a psychopath, l will be curious of his alcohol level is.
I’ve known alcoholics and this is pattern behavior for an alcoholic. They don’t remember anything but they can’t admit it to themselves so they create a story about what happened. They truly think they remember but they don’t. Plus as soon as they go into a different room they forget about what happened in the other room. She willingly gave over her phone because she had no memory of the articles she made. None of this is an excuse and she should be held accountable but I don’t think it rises to the level of intentional m*. They both abused each other and abused substances together. This type of thing was bound to happen in this type of relationship. I think negligent homicide and 10 year sentence is what I would give if I were in charge.
Thank you both for this,love your podcasts, to me this is presented as lawyer and juror, great questions Whitney, re why say she didn’t have much to drink, my experience of being once married to an alcoholic is they are often in denial, i personally think she could have a personality disorder, whether caused by the alcohol, i dont know, its just my opinion, i have a couple of questions, im assuming jorge volunteered to get in the suitcase and allowed her to zip it up ? Does that make a difference, also the suitcase had clearly been moved and turned over given the marks on the carpet which i assume would make it harder to get out,and as Whitney points out,how can it be hide and seek if you are both involved in the ‘hiding ‘ ? I dont think she has a chance here.
Peter – we know now that Defendant Boone has an attorney- but is there any legal language that explains to the jury that this client is Pro-se? … it leaves me wondering so many potential jurors would have no idea why the defendant doesn’t have a lawyer and to them it looks unfair so they vote differently? It seems like there needs to be some kind of jury instructions that explain pro se defendants
The crazy thing to me in this case is that she just won’t accept accountability. All she had to do was humble herself and admit that she is an alcoholic, and show remorse that her disease led to the death of someone she loved. I believe her that her intentions were not to unalive Jorge, and that when she went upstairs to the bedroom it was to scare him even more (which is horrible and unimaginable) but she likely imo was so black out drunk (clear to me since she didn’t even recall that she articletaped herself taunting him in suitcase) and her black out drunk self passed out on the bed in turn why she never went back down to get him out . She literally is her own worst enemy. But she proved who she is because this should have been a wake up call that she has a serious alcohol problem and her disease ended in someone’s unaliving that she claims to love. If she is as smart as she claims to be she could have accepted responsibility that her disease led to the unthinkable. Show remorse that she never got her addiction under control sooner. She could have said ghat in the past he licked her in a room for hours and she took this opportunity to show him how it feels and her drunk self was so black out wasted that she had no concept that she was that bad and when she went upstairs she passed out which in turn led to her not letting him out, and waking up to realize the horrific outcome of that chain of events. But of course she is incapable of accepting her disease, or holding herself accountable.
My feeling is Sarah has never been in a situation where she has to take ownership of something she did wrong. The fact that I was an A student being the first thing out of her mouth describing herself screams out m so better than you all this is do below me. If I say I didn’t mean to do it, you can trust me- I’m without fault.
There’s no way this lawyer will withdraw. The minute Sarah has the urge to start whining or insulting, she will remember how terrified she was to find herself acting pro se. She was really, really scared. She won’t run this lawyer off. She knows how hard it was to get him and she doesn’t want to take a chance on him withdrawing. He has her over a barrel and I can only imagine he has her toeing the line!
I believe Sarah hit Jorge with a baseball bat upstairs. She clearly says several times the suitcase was in the closet in the back back back and the closet was a mess because they needed to get rid of her son‘s clothes, to me the suitcase already being downstairs would not make sense if it had not been filled with clothing yet which it was not, I think she hit him with the bat and put him in suitcase, then kicked the suitcase downstairs and proceeded to record then kicked it over again and record again. The Corner said there’s head trauma face trauma, and head which would not have come from the suitcase, I believe it came from the bat.
I believe she put him in the suitcase, as she said herself in the police call that she put him in there. Also there was stuff in the suitcase, it wasn’t empty, if he got in himself it probably would of been empty for more room in it. As well the neighbor said they heard them fighting badly then all of a sudden it went quiet then the thudding down the stairs. so i believe she knocked him out somehow and put him in there and then dragged him down the stairs. I dont think he got in there on his own.
