In Utah, Are Magic Mushrooms Allowed?

Utah lawmakers are considering legalizing “magic mushrooms” or psilocybin for medical purposes, including depression, anxiety, and PTSD. The state classifies psilocybin as Schedule I in Utah Code Ann. § 58-37-4, which includes substances that are dangerous and have no medical potentia. This groundbreaking legislation opens the door for healthcare systems to explore the therapeutic potential of psychedelics under stringent regulatory oversight. A new Utah proposal would create a pilot program for the medical use of psilocybin, which could be used to treat depression, anxiety, and PTSD.

The bill defines terms, authorizes the production of psilocybin and psilocybin products, and requires the Department of Agriculture and Food (UDAF) to treat patients with psilocybin and MDMA. Doctors at Utah’s two largest health care systems will have the option to treat patients with psilocybin and MDMA, illegal drugs being fast-tracked for development by the Food and Drug Administration. Psilocybin, or the hallucinogenic substance found in specific mushrooms, is making headlines as more states look to decriminalize it for various medical purposes.

Psilocybin is illegal in Utah, and possession or use can result in criminal charges. Research has shown that psilocybin-assisted therapy in conjunction with psychotherapy can relieve major depressive disorder symptoms in adults for at least a year. While Oregon legalized the use of psilocybin more than two years ago, roughly a third of the state’s counties and cities are now proposing legalization for psychedelic drugs.

  • The science isn’t there? What do you mean? Did the Gov ACTUALLY look into it or is he just spouting his uninformed opinion? Also, how will the science ever get there if we don’t allow the medical and psychology fields to even study it? Perhaps the Gov should read some books and talk to some professionals before he speaks.

  • The science may not be a 100 percent there, but telling people who may be on the verge of ending their own lives from treatment resist depression that they cant do it is INSANE. Passing a bill that AT LEAST allows it after someone has tried a few medications, and still have bad depression should be allowed. I dont understand how anyone can think any different, you literally have be completely deranged, or a sociopath. These substances have save countless lives from suicide, and drug overdose.
