Psychedelics, including psilocybin, MDMA, LSD, and other hallucinogens, are not fully legal in the United States. However, Oregon has taken an unprecedented step in offering psilocybin, also known as magic mushrooms, to the public. On January 1, Oregon became the first state in the nation to legalize the adult use of psilocybin, a naturally occurring psychedelic that has shown significant promise. Colorado voters approved a ballot measure legalizing the use of psilocybin and psilocin, two psychedelic compounds found in magic mushrooms, in Tuesday’s midterm elections.
As of 2024, some psychedelics have been given a legal or decriminalized foothold in parts of Central Africa (Equatorial Guinea, Cameroon, Republic of the Congo), South Africa, Australia, and other countries. The legal status of unauthorised actions with psilocybin mushrooms varies worldwide. Psilocybin and psilocin are listed as Schedule I drugs under the United States.
In Canada, the production, sale, and possession of magic mushrooms are illegal. Calls to poison control centers spiked across the US for adolescents and young adults exposed to the hallucinogen psilocybin. Oregon voters approved Measure 109 in 2020, the first law in the United States that establishes a psychedelic services act.
The push to legalize magic mushrooms, MDMA, LSD, and other hallucinogens is likely to heighten tensions between state and federal law.
